MyNomadToolkit is a product and service brand operated by Go Helvetia LLC, a Wyoming limited liability company with its principal mailing address at 30 North Gould Street, Suite R, Sheridan, WY 82801, United States (“Go Helvetia,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of the MyNomadToolkit website, applications, APIs, dashboards, and related services (collectively, the “Service”). By creating an account, completing a purchase, or otherwise using the Service, you agree to these Terms, our Privacy Policy, Cookie Policy, Refund Policy, and Acceptable Use Policy.
1. Eligibility and accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You agree to provide accurate registration information, keep credentials confidential, and remain responsible for all activity under your account. Notify us promptly at hello@mynomadtoolkit.com if you suspect unauthorized access.
2. Description of the Service
MyNomadToolkit offers digital communications products that may include: (a) virtual or VoIP-capable phone numbers for voice and messaging; (b) online fax send/receive features; and (c) travel data eSIM or similar connectivity products. Features available to you depend on the plan, country, and inventory you purchase. We deliver the Service using infrastructure and telecom partners. Number availability, routing, and carrier features may change without notice.
3. Not a traditional telephone company; emergency calling and E911 registration
The Service is an internet-based communications offering and is not a traditional landline or wireless carrier service. 911 calling is enabled only for a US-declared voice number whose E911 address our carrier has confirmed as active. It is disabled for any number declared for use outside the United States and for any US number whose E911 registration is not active. Even when enabled, emergency calling over VoIP may be unavailable during power, internet, device, or provider outages; may not transmit accurate location; and may not work the same way as traditional telephony. Do not rely on the Service as your only means to reach emergency services. Maintain an alternate phone or method to call 911.
For an outbound-capable US voice number, US emergency-address rules require a registered location. Before outbound calling and 911 are unlocked, you must give us the US address where emergency services should find you, and we register it with our carrier. You must keep that address accurate and update it if you move. Registration is not a guarantee that 911 will work in every outage. If you declare the number for use outside the United States, 911 calling is switched off for that number in the app and on our servers; you must change the declaration and register a US E911 address before using the number for 911 in the United States.
4. Acceptable use and compliance
You must use the Service lawfully and in accordance with our Acceptable Use Policy. You are solely responsible for complying with telemarketing, spam, privacy, export, recording-consent, and telecommunications laws that apply to your use (including the U.S. Telephone Consumer Protection Act where applicable). We may suspend or terminate accounts that create regulatory, fraud, or network risk.
5. Orders, billing, and subscriptions
Prices are shown at checkout in the currency indicated and are generally charged in advance. Recurring plans renew automatically for successive terms unless cancelled before renewal according to the cancellation controls in your account or by contacting billing@mynomadtoolkit.com. Refunds are available only during the first 30 days of a paid period: we retain one month of service and the payment-processing fees, and return the remainder. After 30 days you may cancel, but no refund is issued for any service. The amount returned, the charges retained, and the effect of repeated cancellations are set out in our Refund Policy. Taxes, regulatory fees, and carrier surcharges may apply. Coupons and promotions are subject to their stated limits. Digital goods are provisioned electronically; see our Refund Policy for refund rules.
US voice numbers: when you tell us you are physically located in the United States, a separate E911 address-registration fee of US$19.99 per year is added at checkout. The fee covers the carrier's emergency-address registration and handling; that registration is what enables 911 calling for the US number once the carrier confirms it. It does not guarantee that 911 will work during an outage. The fee is required to maintain an outbound-capable US number under carrier rules. If you change an existing number to US use after purchase, the fee is charged for the remaining months of the current plan plus one month, at the monthly rate, capped at the annual fee. If an annual fee is charged, coverage runs for one year from the later of the change date or the end of the current plan. If we cannot register the address, contact hello@mynomadtoolkit.com and we will help or refund the undelivered portion as required by law.
If you tell us you are physically outside the United States, you confirm at checkout that you will not use that number in the United States until you have added a registered E911 address. Outside the United States, 911 calling through the number is unavailable: it does not connect to the emergency services where you are, and you must use a local phone or local emergency number instead. Using the number in the United States without a registered address may violate carrier rules and emergency-services requirements.
6. Numbers, messaging, fax, and portability
Phone numbers and messaging/fax capabilities remain subject to carrier rules, numbering authorities, and geographic availability. We do not guarantee uninterrupted service, specific caller-ID presentation, or delivery of every message or fax. We may reclaim, reassign, or refuse numbers that are unused, misused, obtained under false pretenses, or required to be returned by law or a partner. Number porting, if offered, depends on third-party processes and is not guaranteed within any timeframe.
App-sent SMS to US mobile numbers is application-to-person (A2P) traffic. US carriers require the sending local number to be registered under 10DLC, including when the message is personal. Registration is separate from the number plan and costs about US$60 per year; contact hello@mynomadtoolkit.com to arrange it. Some carriers and some VoIP destinations may accept messages without 10DLC, but we do not guarantee delivery of any outbound message. Incoming SMS is not affected by 10DLC registration. You remain responsible for consent and for complying with the Telephone Consumer Protection Act and carrier rules.
You are responsible for the accuracy of any US emergency address you provide. A false, incomplete, or outdated address may prevent emergency responders from finding you and may result in suspension or termination. Outbound calling and 911 on a US voice number remain locked until the carrier confirms the emergency address as active.
7. Travel eSIM and data services
eSIM and data packages are provided for lawful personal or business use subject to partner network coverage. Speeds, fair-use policies, roaming restrictions, and geographic coverage are controlled by underlying networks. Activated data allowances are generally non-transferable. Device compatibility is your responsibility.
8. Third-party services
Payment processing, cloud hosting, authentication, telecom, and eSIM partners process data as needed to operate the Service. Their outages or policy changes may affect availability. Your use of third-party products remains subject to those providers’ terms where applicable.
9. Intellectual property
We and our licensors own the Service, branding, software, and content we provide. You receive a limited, revocable, non-exclusive license to use the Service for your internal purposes. You may not copy, reverse engineer, or resell the Service except as expressly permitted in writing.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO HELVETIA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO HELVETIA LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE—EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
12. Indemnity
You will defend and indemnify Go Helvetia LLC against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, your violation of these Terms or law, or your infringement of third-party rights.
13. Suspension and termination
We may suspend or terminate access immediately for non-payment, suspected fraud, legal risk, Acceptable Use violations, or prolonged inactivity. You may stop using the Service at any time. Provisions that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive termination.
14. Changes
We may update these Terms by posting a revised version on https://mynomadtoolkit.com. Material changes take effect when posted or on a later date we state. Continued use after the effective date constitutes acceptance.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Exclusive venue for disputes that are not resolved informally will be the state or federal courts located in Wyoming, unless applicable law requires otherwise. Before filing a claim, contact legal@mynomadtoolkit.com so we can try to resolve the issue.
